1. Acceptance of these Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you ("you", "your", "User") and Mawi Al-Munzal for Information Technology ("Company", "we", "us", "our"). Please review them carefully.

By downloading, installing, or using Mawa (the “App”), you agree to be bound by these Terms. This applies to you whether you sign up for an account or use the App without registering. If you do not agree to these Terms, in whole or in part, immediately discontinue your use of the App.

2. Account Registration & Security

In order to open an account, you will be asked to provide us with certain information such as your full name and gender. The App collects this information in order to provide the service. For information about your data rights or account deletion, please see our 

Please make sure the information you provide upon registration and at all other times is true, accurate, current, and complete to the best of your knowledge.

You must provide accurate information, keep credentials confidential, and notify us of any unauthorized use. We may suspend or terminate your account at our sole discretion if we believe any information provided is inaccurate, misleading, or if there is any unauthorized or suspicious activity associated with your account.

3. Description of the Services

The App provides:

1. Text & voice messaging between registered users.

2. Location tracking and map visualization powered by Google Maps services.

3. The ability to assign tasks with location data, and to monitor Users in real-time, including location tracking, speed monitoring, estimated route completion time, and deviation alerts.

We reserve the right to add, modify, or remove features at our discretion and may suspend or discontinue the service at any time, with or without prior notice.

4. User Obligations & Acceptable Use

By using the App, you agree not to violate any applicable laws, regulations, contracts, intellectual property rights, or other third-party rights. You are solely responsible for your conduct while using the App.

You further agree not to publish, upload, transmit, distribute, or store any content on the App that is illegal, inaccurate, infringing, defamatory, obscene, pornographic, harassing, threatening, abusive, invasive of privacy or publicity rights, or otherwise prohibited under applicable law.

You must not harass, threaten, defraud, impersonate, or abuse other users of the App, nor collect or attempt to collect personal information about users or third parties without their explicit consent. You may not access or use another user’s account without proper authorization.

Additionally, you must not attempt to reverse-engineer, scrape, interfere with, or disrupt the App or its services in any way, nor attempt to bypass any security features or restrictions implemented within the App.

5. Location Tracking

The App uses third party services such as Google Maps to provide location-based features and services. By using the App, you acknowledge and agree that you will be bound by their privacy policies and terms. We do not control, and are not responsible for, the policies or practices of any third-party services.

Location tracking is optional and requires your explicit permission. You can disable location access at any time through your device’s location settings.

Location data, mapping, and related services may be inaccurate, delayed, or unavailable at times. You use them at your own risk.

6. Intellectual Property

The App, along with all related materials, including images, information, and software, is owned by us and protected under applicable copyright, trademark, and other intellectual property laws. Nothing in this document shall be interpreted, directly or indirectly, as conferring or granting any right, title, interest, or license in or to the App, its services, software, or any related content, including associated patents, data, software, or documentation.

All trademarks, service marks, and trade names referenced in or incorporated into the App, its services, and related content are the property of, or are licensed to, the App. Your use of the App does not grant you any rights or interests in these marks. You agree not to claim any rights to the App, its services, content, or any trademarks used in connection therewith.

You may not sell, license, lease, modify, copy, reproduce, republish, upload, promote, transmit, distribute, publicly display, edit, or create derivative works based on any part of the App or its content for public or commercial purposes without our prior written consent.

7. Suspension & Termination

We reserve the right to restrict, suspend, or terminate your access to the App at any time, without prior notice and for any reason, at our sole discretion. This includes, but is not limited to, violations of these Terms, potential or actual security threats, or any conduct that we, in our sole judgment, consider to be harmful or inappropriate.

On termination you remain responsible for prior breaches.

8. Disclaimers

To the fullest extent permitted by applicable law, the service is provided “as is” with no warranty of any kind, either express or implied. You acknowledge that you are solely responsible for your use of the services, and we expressly disclaim all other warranties, statutory, express, or implied, including but not limited to, the implied warranties as to the accuracy, completeness, reliability, availability or sufficiency of the services, the data upon which it relies, or any associated services.

We make no warranty that the services will be available, accessible, uninterrupted, timely, secure, error free or otherwise meet your expectations. We also expressly disclaim any implied warranties of merchantability or fitness for a particular purpose, and any warranties that may arise from course of performance or course of dealing.

You assume all risk associated with the use of the services, including without limitation that the services may provide incorrect information or that any material downloaded from the App may cause loss of data or damage to your systems.

9. Indemnity

To the fullest extent permitted by applicable law, you agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising out of your breach of these Terms or misuse of the App.

You agree to indemnify and hold the Company, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorney or court fees), made against the Company by any third party due to or arising out of or in connection with your use of the App.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, special, incidental, or consequential damages of any kind. This includes, but is not limited to, damages for loss of use, loss of profits, loss of data, or any other losses, whether arising in an action of contract, tort (including negligence), or otherwise, resulting from or related to your use of, or inability to use, the App, its content, or related materials.

Such limitations apply to damages resulting from reliance on any information obtained from the App or from mistakes, inaccuracies, omissions, interruptions, deletion of files or emails, errors, defects, viruses, delays in operation or transmission, or any failure of performance. They also apply to circumstances resulting from acts beyond our control, including force majeure, communication failures, theft, destruction, or unauthorized access to our systems, records, programs, or services.

We shall not be responsible for any expenses, losses, costs, compensation, or claims of any kind, general, special, or incidental, arising from any actions or events connected with the use of the App or the information it contains.

11. Modifications

We may amend these Terms at any time. Material changes will be notified via the App or by email at least (1) week before the implementation of the modification before they take effect. Continued use after that date constitutes acceptance of the new Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be submitted to the competent courts of Kingdom of Saudi Arabia.

13. Language

The Arabic language shall prevail in the Terms and conditions in the event of a different interpretation or meaning.
